4 • Objective
These general conditions of sale rule the sale of products marketed by 23 St Srls, with registered office at Via Paradiso 5, 20831 Seregno (MB) – ITALY, via the internet website www.23stbeauty.com to consumeing users.
The General Conditions of Sale shall take effect on the date of acceptance of the same, by the customers of our website, which is in effect an acceptance pursuant to art. 1341 of the Italian Civil Code.
23 St Srls reserves the right to modify at any time the current general terms and conditions of sale by editing them on the website.

5 • Purchase
The purchase of products is through access to the website and later registration.
For each product there is a description of its main features available on the website. All support information for purchasing are intended as mere material for general information; it is understood that the picture accompanying the description of the product may not be fully representative of its features but may differ in color, size, products, labels and packaging.The images shown here are for illustrative purposes only.
A correct order is confirmed by 23 St Srls with an automatic response by e-mail, sent to the email address supplied by the customer at the time of his registration.
This confirmation message will contain an “Order Number” to be used in case of any communication with 23 St Srls.
The message will include all data entered by the customer who agrees to verify the correctness and to promptly communicate any corrections. In the case of non-acceptance, 23 St Srls ensures timely notification to the customer.

6 • Payment
All prices on the website shall be construed as prices to the public and therefore inclusive of Value Added Tax (VAT).

Prices may change without prior notice and the only price to be considered to be the correct one, is the one indicated at the time of order confirmation.
On certain products that are subject to promotional price, 23 St Srls promotions reserves the right to accept orders by reducing the total amount of items, upon notice and acceptance by the customer, the failing of which will determine an order cancellation.

PAYMENT: You can use both credit or debit cards (Visa, Mastercard, Visa Electron, Postepay, Discover, Master Card Aurea) from the main international networks or PayPal. You will be charged when placing your order, in the same currency as the prices you see on the website.
The commercial invoice must be requested contacting the Customer Service before completing the order online or at least before the shipment confirmation email. We will not be able to provide it later.

7 • Shipping
In order to ensure an accurate and timely delivery to customers, 23 St Srls ships only via DHL GoGreen Solutions (DHL GOGREEN SOLUTIONS: offer a number of service options for minimizing and/or avoiding logistics-related emissions, waste and other environmental impacts along your entire supply chain).
For each order 23 St Srls will print either a receipt or a Transportation Document relative to the order, followed by the creation of the invoice according to current laws.
For each invoice, the information provided by the customer at the time of the order will be used. The customer may request a copy of the invoice or receipt within a period of three months from the purchase.
The are no shipping costs within Italy for amounts equal to or greater than € 89.00 in all other cases: €3,9 for orders over €69 and
€6,9 for orders under €69. We will be adding the shipping costs, by specifying them clearly before the order is confirmed, upon confirmation and also at final validation. For deliveries within the European Union the cost is € 7.90 for shipments less than € 120.00 and free for orders over € 120.00
For shipments to the rest of the world the rate is € 29.00 for all orders below € 250.00.
Upon delivery, the customer is required to check:
a) that the packaging is intact, not damaged or wet or otherwise altered;
b) that the number of packages is as specified by the Transportation Document.
Any damages to products or their packaging, or any mismatch of indications, must be immediately reported to the courier and notified by writing “written request of verification (riserva di controllo scritta)” on the proof of delivery of the courier.
Once the courier has signed the document, the customer can not make any objection about the conditions of the item that was delivered. If you fail to collect the item within 5 working days after its storage at the warehouses of the courier, after they repeatedly failed to deliver it to the address specified by the customer at the time of the order, due to the absence of the recipient, the order will be considered as closed, and subject to the possibility of proceeding to a further delivery at the recipient’s expense.

8 • Warranty
23 St Srls does not provide any additional product warranty other than that provided by individual producers.

9 • Liability
23 St Srls guarantees to consumers that all products provide users with the quality standards recognized by applicable law at the national and local scale and with any other parameter required by retail markets.
23 St Srls shall have no liability, direct, indirect or of any other nature, towards the consumers or any third parties in the event that the products are used in a way that is not in accordance with the purpose of use of the goods or for any damages arising from manufacturing defects not specified by the terms of Article 8.

10 • Right of withdrawal/return
According to Article 52 of the Code of the Italian consumption and subject to the exceptions in Article 59 of the Code (see in particular the purchase of goods hypotheses clearly personalized or supply of sealed goods which are not suitable to be returned for hygienic reasons or related to the protection of health and were unsealed after delivery.)

The Purchaser has the right, within 14 working days of delivery of products purchased, to exercise the right of withdrawal in the manner guaranteed by law consisting in the right to return the products received and to obtain reimbursement of the price paid, without penalty and without any reason. This right applies to all products contained in www.23stbeauty.com site. Products must be returned with their original packaging, accessories, instructions for use and anything else with them provided.

To exercise the right of withdrawal/return under Article 6 the Purchaser and / or recipient of the Order will have to write an e-mail to hello@23stbeauty.com, alternatively, and only up to the withdrawal under Article 6 the customer can communicate the withdrawal to 23 St Srls through an unequivocal statement ( Registered letter via regular mail). To comply with the withdrawal period the Purchaser shall send the Rhesus or explicit communication module before the expiration of the applicable withdrawal period.
Upon receiving the communication, 23 St Srls will notify the customer of the procedure.
The customer shall promptly arrange the shipment addressed to 23 St Srls. The transport costs and the responsibility of the goods during shipment, as ruled by law, shall be borne by the customer.
It is recommended that you insure the goods with the courier of choice, taking care to carefully pack the goods and, where possible, by inserting them into an outer box, without damaging the original packaging by means of adhesive tapes, labels, etc.
The product must be returned inside its original packaging along with all its parts and accessories.
In case a transportation damage occurred during the return, 23 St Srls will communicate the same to the customer within five working days of the delivery of the goods, allowing him to file a claim with the carrier used for delivery.
The damaged goods will be available for return and the withdrawal request will be simultaneously canceled. Unless repairing costs will be undertaken, 23 St Srls will refund customers fully within 14 days, counting from the day the purchased goods were received, by canceling the credit card charges, or by wire transfer to the bank account specified by the customer.
The right of withdrawal is lost if the products are returned in damaged conditions (for reasons other than transportation), incomplete, with missing parts, or with a damaged packaging.
We do not refund packages that were opened or used.
This article is of informative nature on the right of withdrawal pursuant to Art. 47 of Legislative Decree. N. 206/2005 (IT).

11 • Applicable law
This sales contract between the customer and 23 St Srls is sealed in Italy and ruled by Italian law. Unless otherwise stated, respective Italian law will be applied. For the resolution of disputes arising from the conclusion of this sales contract, the local jurisdiction is that of the Court of Monza (MB) – Italy, to which 23 St Srls refers.
Pursuant to Article 1341 and Article 1342 of the Italian Civil Code the Parties, according to the terms and conditions set out in these Conditions of Sale and, in particular, the conditions and Articles 2, 3, 4, 5, 6 , 7 and 8 of this Agreement, specifically declare their consent, without any possible exception.
